Authorities in Gainesville have arrested a 70-year-old man who reportedly pointed a gun at and pistol-whipped a pair of teens after he became angered by them riding an ATV.
The incident was reported on Saturday at the 9500 block of NE 108th Avenue.
Police say Elmer Smith confronted the 13-year-old and a 16-year-old saying that if they did not stop tearing up to road with their ATV they would have “big f***ing problems.”
The 16-year-old then asked what kinds of problems they would have and that’s when Smith reportedly got out of his vehicle and pointed a handgun at the two teens while walking towards them.
When Smith was close enough to the 16-year-old, he then struck the teen in the chest with the gun and the two began to fight. The 13-year-old was said to have joined in on the fight and kept the gun away from Smith after he dropped it in the scuffle.
When authorities arrived at the scene, Smith told them that the teens jumped him and then retrieved his gun from the car.
Smith was taken to The Alachua County Jail and charged with two counts of aggravated assault with a deadly weapon and one count of aggravated child abuse. He, however, has since been released from custody as for Sunday.
